Welcome to the website of LKS Fermentations LLC (“Hen & Hound Farm Brewery,” “we,” “us,” or “our”). Please read these Terms and Conditions (“Terms”) carefully before using our website, placing an order for pickup, or interacting with our services.

By accessing or using our website, ordering products through our GoTab point-of-sale or online ordering platform, or subscribing to our communications, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you may not access or use our website or online services.

1. Age Limit Requirement (21+)

Our website, products, and online ordering services are intended solely for individuals who are at least twenty-one (21) years of age. By using our website or placing an order for alcoholic beverages, you represent and warrant that:

  • You are at least 21 years old.
  • Any recipient or individual picking up an alcoholic beverage order is at least 21 years old.

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion if we suspect you are under the legal drinking age.

2. Online To-Go Beer & Merchandise Orders (GoTab)

All online orders for pickup at our brewery are processed using GoTab, our third-party point-of-sale and online ordering platform.

A. ID Verification Upon Pickup

  • Valid Photo ID Required: Federal, Maryland state, and local laws strictly govern the sale and transfer of alcoholic beverages. Every customer picking up an order containing alcohol must present a valid, unexpired, government-issued photo ID (driver’s license, passport, or military ID) proving they are 21 years of age or older.
  • Right to Refuse Pickup: Hen & Hound Farm Brewery team members reserve the absolute right to refuse the release of alcoholic beverages if:
    • A valid ID is not presented upon pickup.
    • The ID appears fraudulent, altered, or unverified.
    • The individual picking up appears to be intoxicated.
    • The individual picking up is unable to prove they meet the minimum legal drinking age.

B. Pickup Location & Timing

  • All online orders are for in-person pickup only at our farm taproom located at 23433 Ringgold Pike, Smithsburg, MD 21783. We do not ship alcoholic beverages.
  • Orders must be picked up during our designated taproom operating hours. Orders not collected within forty-eight (48) hours of the scheduled pickup time may be canceled without refund unless prior arrangements have been made with our staff.

C. Order Changes, Cancellations & Refunds

  • Due to the perishable nature of craft beer, all online sales are final once processed, except where required by law or approved by Hen & Hound Farm Brewery management.
  • If an item you ordered is out of stock or unavailable, we will notify you and offer a substitution or a full refund to your original payment method.

3. Pricing, Payments, and Tax

  • Pricing: All prices listed on our website and GoTab platform are in U.S. Dollars (USD) and are subject to change without notice.
  • Taxes: Applicable Maryland sales and alcoholic beverage taxes will be added to your order total at checkout.
  • Payment Processing: Payment is required at the time of placing an online order. Payments are securely processed through GoTab’s PCI-compliant payment gateways. Hen & Hound Brewing does not directly store complete credit card information on its website servers.

4. Intellectual Property Rights

All content on this website—including but not limited to the Hen & Hound Brewing name, LKS Fermentations LLC, logos, beer titles, label graphics, trade dress, website layout, text, images, and original artwork—is the exclusive property of LKS Fermentations LLC and is protected by United States trademark, copyright, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to view and print pages from our website for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publically display, or commercially exploit any content without our prior written consent.

5. Third-Party Links & Services

Our website and ordering workflows integrate with third-party tools and platforms, including GoTab (POS and ordering), Fishbowl (email communications), Google Analytics/Ads, and Meta Ads. We do not control these third parties and are not responsible for their content, policies, or practices. Your interactions with these platforms are governed by their respective terms of service and privacy policies.

6. Prohibited Conduct

When using our website or online services, you agree not to:

  • Use the site for any unlawful purpose or in violation of local, state, or federal laws.
  • Impersonate any person or entity, or misrepresent your age or identity.
  • Attempt to gain unauthorized access to our servers, website architecture, or ordering systems.
  • Use automated scrapers, bots, or data harvesting methods on our site.
  • Post or transmit any abusive, fraudulent, or harmful content.

7. Disclaimer of Warranties

OUR WEBSITE, SERVICES, AND PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, LKS FERMENTATIONS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LKS FERMENTATIONS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH:

  • YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) OUR WEBSITE OR ONLINE ORDERING SYSTEM.
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OR THROUGH OUR SERVICES.
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
  • REGISTRATION OR PICKUP OF ALCOHOLIC BEVERAGES IN VIOLATION OF APPLICABLE LAWS.

9. Indemnification

You agree to defend, indemnify, and hold harmless LKS Fermentations LLC (dba Hen & Hound Brewing), its managing members, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, losses, or costs (including reasonable legal fees) arising out of or related to your violation of these Terms, your misuse of our website or services, or your violation of any law or third-party rights.

10. Governing Law and Jurisdiction

These Terms and any disputes arising out of or relating to them or your use of our website or services shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Washington County, Maryland.

11. Severability & Waiver

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term.

12. Changes to These Terms

We reserve the right to revise or update these Terms at any time without prior notice. Any changes will become effective immediately upon posting the revised Terms to our website with an updated “Effective Date.” Your continued use of our website or online ordering services following any updates constitutes acceptance of those changes.
